In today’s employment environment, businesses are continually involved in litigation to justify its use of independent contractors. Businesses may be in compliance with the IRS legal test to determine who is an independent contractor but may not be in compliance with wage and hour or other legal tests. To make matters more complex, states have enacted their own independent contractor tests, leaving businesses confused on how to comply. If that is not enough, the National Labor Relations Board recently issued its own legal test that applies to all businesses and the Department of Labor will be issue its version this year.
