For over a decade now the EEOC has been choosing its litigation targets according to a detailed Strategic Enforcement Plan. The heart of the plan is a list of six enforcement priorities, such as “eliminating barriers in recruitment and hiring” and “protecting vulnerable and underserved workers.” Those priorities have remained largely the same over the years, but they have been interpreted very differently by different presidential administrations. This webinar will discuss the EEOC’s most recent litigation activity within the context of this history to better understand how it perceives its mission today. The goal is to identify the patterns and pitfalls that may make employers more likely targets for enforcement activity and to provide some thoughts and guidance on what employers can do to avoid that.
