The purpose of the Healthcare Council is to develop and take actions to achieve affordable, accessible, efficient, high quality healthcare for the employers and residents of our state. The Council represents employers in seeking market-based approaches to help them provide affordable, quality healthcare coverage for their employees and works closely with providers to help strengthen Illinois’ healthcare system.

Chamber Files Amicus Brief
The Illinois Chamber joined with 14 other state chambers and business organizations to file an amicus brief with the U.S. Supreme Court challenging the applicability of the Anti-Injunction Act in the case U.S. Department of Health and Human Services, et all v. the State of Florida, et al. The brief relies on two main arguments: 1) the Anti-Injunction Act does not prohibit the Supreme Court from ruling on the constitutionality of the individual mandate and 2) any delay in ruling would exacerbate employer uncertainty and result in increased costs for employers.
The Illinois Chamber is also supportive of the points raised in the U.S. Chamber’s amicus brief that argue the individual mandate should not be considered severable from the rest of the Act; however, we wanted our brief to raise an argument that other business groups had not yet raised because we do have concerns that the Supreme Court could delay ruling on the constitutionality of the Act, specifically, the individual mandate if they rule the mandate a “tax” rather than a “penalty.” The Anti-Injunction Act bars legal challenges on any “tax” before it is actually assessed and paid, which would effectively delay legal action until after 2014.
