The question every employer asks when it receives a lawsuit, claim or charge filed against it by an employee or former employee is…
“Can I sue him?  Can I sue her? Can I recover my attorneys’ fees if we win?”

The reality is that most defense attorneys will respond “NO”! This 90 minute webinar is designed to address in a more sophisticated and thorough fashion the good, the bad and the ugly in pursuing litigation against an employee or former employee, including the upside, downside, pros and cons of going down that avenue.  There are laws in place that protect employers from frivolous and/or bad faith allegations against it.  There are also laws in place that will allow an employer to pursue action against an employee or former employee who has committed wrong against the employer, not relating to the employee’s allegations.  There are laws in place that allow an employer, upon a successful defense, to pursue costs, and in rare cases, attorneys’ fees, against an employee or former employee.

This 90 minute webinar is not to advocate for employers to pursue legal action against employees.  Rather, it is designed to educate and address common myths and misconceptions, and discuss viable methods by which an employer can realistically turn the tables against an employee or former employee under appropriate rule of law.

SmithAmundsen’s Labor & Employment Practice Group will be addressing this topic and providing participants with real world examples and case law developments.
