imminent return of the NLRB’s “Ambush Election” rules that will dramatically lessen the time for employers to respond to a formal union petition together with the DOL’s attempt to gag an employer’s ability to effectively seek advice and counsel when responding to union activity through its proposed “Persuader Rule”, employers need to proactively manage the threat of union organizing today.
